Waste Removal Kennington Service Terms and Conditions

These Terms and Conditions set out the basis on which Waste Removal Kennington provides waste collection and related services to residential and commercial customers. By booking or using our waste removal services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person, business or organisation requesting and paying for the services.

Services means any waste removal, waste collection, loading, transportation, clearance, recycling, or disposal services provided by Waste Removal Kennington.

Waste means any materials, items, refuse, rubbish, junk or other substances presented for collection by the Customer as part of the Services.

Agreement means the contract between the Customer and Waste Removal Kennington incorporating these Terms and Conditions and any confirmed booking details.

2. Scope of Services

Waste Removal Kennington provides waste collection and removal services for households, offices, retail premises and other sites. Services may include, but are not limited to, general rubbish collection, bulky waste removal, garden waste clearance, light construction waste removal and mixed waste clearance.

The precise scope of the Services will be confirmed at the time of booking based on the description of the Waste, access to the property and any special requirements notified by the Customer. Waste Removal Kennington reserves the right to refuse to collect any items that fall outside the agreed scope or that cannot safely or legally be transported or disposed of.

3. Booking Process

3.1 Bookings may be made by telephone or email. The Customer must provide accurate information, including the type and approximate volume of Waste, the collection address, contact details, access instructions and any relevant parking or loading restrictions.

3.2 Waste Removal Kennington will provide an indicative price based on the information supplied by the Customer. This price may be subject to confirmation or adjustment following inspection of the Waste on arrival.

3.3 A booking is only confirmed once the Customer has accepted the quoted price and the proposed collection date and time, and Waste Removal Kennington has issued a booking confirmation.

3.4 Collection times are approximate. While Waste Removal Kennington will use reasonable efforts to attend within the agreed time slot, arrival times may vary due to traffic, previous jobs or other circumstances beyond reasonable control. Time shall not be of the essence in respect of arrival times.

4. Customer Responsibilities

4.1 The Customer is responsible for ensuring that:

a. The Waste is accurately described at the time of booking.

b. Reasonable access is provided to the collection point at the agreed time, including any necessary access codes, security instructions or permits.

c. Any required parking permissions or dispensations are arranged in advance, unless otherwise specifically agreed.

d. The Waste is ready for collection and is not contaminated with hazardous or prohibited materials unless such materials have been specifically declared and accepted in writing.

4.2 If the crew cannot gain access, if Waste is significantly different in type or volume from that described, or if the job cannot be carried out safely or legally, Waste Removal Kennington may cancel or amend the booking and charge a reasonable call-out or waiting fee.

5. Waste Types and Prohibited Items

5.1 Waste Removal Kennington operates in accordance with UK waste management regulations and duty of care requirements. The Customer must not present for collection any waste that is unlawful, hazardous or otherwise unsuitable for the agreed service.

5.2 Unless specifically agreed in writing, the following items and materials will not be collected: asbestos, clinical or medical waste, chemicals and solvents, batteries in bulk, gas cylinders, explosives, radioactive materials, liquids in unsealed containers, and any other substances classified as hazardous under applicable UK legislation.

5.3 Electrical items, mattresses, fridges, freezers, tyres and certain other controlled waste streams may be subject to additional charges or special handling conditions. The Customer must inform Waste Removal Kennington in advance if such items are to be collected.

5.4 If hazardous or prohibited materials are discovered in the Waste, Waste Removal Kennington may refuse to remove them, may adjust the price to reflect additional handling or disposal costs, and may report any serious breach of waste law to the appropriate authority.

6. Pricing and Payments

6.1 Prices are normally based on the estimated volume and weight of Waste, the type of materials, ease of access, and any additional services such as dismantling or extra labour.

6.2 The indicative price given at the time of booking is not binding if the Waste is substantially different in quantity or nature from the Customer description. The crew will assess the Waste on arrival and confirm the final price before loading.

6.3 Payment is due on completion of the Service unless otherwise agreed in writing. Waste Removal Kennington accepts common UK payment methods such as debit and credit card, bank transfer or cash, subject to any limits or requirements notified to the Customer.

6.4 For business Customers or account holders, separate invoicing terms may apply, including agreed credit periods. Any such terms must be agreed in writing.

6.5 Waste Removal Kennington reserves the right to charge interest on overdue amounts at the statutory rate and to recover all reasonable costs of debt collection where payments are not made in accordance with agreed terms.

7. Cancellations, Rescheduling and Waiting Time

7.1 The Customer may cancel or reschedule a booking by giving at least 24 hours notice before the agreed collection time. In such cases, no cancellation fee will normally apply.

7.2 If the Customer cancels with less than 24 hours notice, or fails to give access to the property at the agreed time, Waste Removal Kennington reserves the right to charge a cancellation or call-out fee to cover crew time, travel and administration costs.

7.3 If the crew is required to wait for more than a reasonable period due to lack of access, incomplete preparation or other issues caused by the Customer, additional waiting time charges may be applied at a rate notified by Waste Removal Kennington.

7.4 If Waste Removal Kennington needs to cancel or reschedule a booking due to operational or safety reasons, the Customer will be informed as soon as reasonably practicable and a new time will be offered. Waste Removal Kennington shall not be liable for any indirect losses arising from such changes.

8. Performance of Services

8.1 Waste Removal Kennington will perform the Services with reasonable care and skill, using properly trained personnel and appropriate equipment for the type of job.

8.2 The crew will take reasonable care to avoid damage when removing Waste from the Customer premises. However, the Customer should protect any delicate surfaces, flooring or fixtures in areas where Waste is to be carried.

8.3 The Services are limited to waste collection, removal and disposal. Unless expressly agreed, Waste Removal Kennington does not undertake cleaning, deep clearance beyond the agreed areas, or making good of any surfaces or structures.

8.4 Once the Waste has been loaded onto the vehicle and payment has been made or agreed, title to the Waste passes to Waste Removal Kennington, which will then arrange for lawful treatment, recycling or disposal.

9. Liability and Limitations

9.1 Nothing in these Terms and Conditions shall limit or exclude liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other matter that cannot lawfully be limited or excluded under UK law.

9.2 Subject to the above, the total liability of Waste Removal Kennington for any loss or damage arising out of or in connection with the Services and this Agreement, whether in contract, tort or otherwise, shall be limited to the total price paid or payable for the specific job giving rise to the claim.

9.3 Waste Removal Kennington shall not be liable for any indirect or consequential losses, including loss of profit, loss of business, loss of opportunity or any similar losses suffered by the Customer or any third party.

9.4 The Customer is responsible for removing any personal items, valuables or documents from Waste or from areas where the crew will be working. Waste Removal Kennington cannot accept responsibility for items later alleged to have been discarded with the Waste unless the Customer can show clear evidence of negligence.

9.5 Waste Removal Kennington shall not be responsible for any delay or failure to perform the Services due to events beyond its reasonable control, including traffic incidents, extreme weather, industrial action or restrictions imposed by authorities.

10. Compliance with Waste Regulations

10.1 Waste Removal Kennington is committed to operating in accordance with applicable UK waste legislation, including duty of care responsibilities, carrier licensing obligations and relevant environmental regulations.

10.2 Waste collected from Customers will be transported only to authorised facilities for sorting, recycling, recovery or disposal. Where required by law, documentation may be generated to record the transfer and treatment of controlled waste.

10.3 The Customer must co-operate with any reasonable request for information required to complete waste documentation or to comply with regulatory obligations.

10.4 If the Customer provides Waste that is misdescribed, unlawfully stored, or non-compliant with relevant regulations, the Customer shall be responsible for any fines, penalties, extra costs or liabilities incurred by Waste Removal Kennington as a result.

11. Complaints and Queries

11.1 If the Customer is dissatisfied with any aspect of the Services, they should contact Waste Removal Kennington as soon as possible, providing full details of the issue and any supporting evidence.

11.2 Waste Removal Kennington will investigate complaints promptly and seek to resolve them in a fair and reasonable manner. Where appropriate, a partial refund, price adjustment or re-visit may be offered, at the discretion of Waste Removal Kennington.

11.3 Raising a complaint does not entitle the Customer to withhold payment for Services already properly rendered, unless Waste Removal Kennington has agreed to such withholding in writing.

12. Data Protection and Privacy

12.1 Waste Removal Kennington will collect and process personal data from Customers only as necessary to manage bookings, perform the Services, handle payments and communicate regarding the Agreement.

12.2 Customer data will be handled in accordance with applicable UK data protection law. Personal information will not be sold to third parties. It may be shared with service providers involved in delivering the Services or with authorities where required by law.

13. Variations to Terms

13.1 Waste Removal Kennington may update or amend these Terms and Conditions from time to time. The version in force at the time of the Customer booking will apply to that booking.

13.2 Any variation to these Terms and Conditions requested by the Customer shall only be effective if agreed in writing by an authorised representative of Waste Removal Kennington.

14. Severability

14.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed deleted and the remaining provisions shall continue in full force and effect.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or with the Services shall be governed by and construed in accordance with the laws of England and Wales.

15.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of Services by Waste Removal Kennington.

By making a booking with Waste Removal Kennington or allowing our team to begin work, the Customer confirms that they have read, understood and agree to be bound by these Terms and Conditions.
